1. Purpose of the App

The App is designed to support search and rescue, safety awareness, and related functions. It is only a support tool and not a substitute for emergency services. Copernix does not guarantee detection, communication, location accuracy, or rescue. In an emergency, contact local emergency services immediately.

2. Eligibility

You must be at least 18 years old or use the App under the supervision of a legal guardian. You are responsible for ensuring your use of the App complies with applicable law.

3. Free and paid features

The App may offer free features and paid features, including subscriptions or one-time purchases (“Premium Services”).

Premium Services may be billed through third-party providers such as Apple or Google. Prices may change with notice. Subscriptions renew automatically unless cancelled by you. You are responsible for managing cancellations, and refunds are subject to the policies of the applicable platform provider.

4. No guarantee of performance

You acknowledge that App performance may depend on device hardware, battery status, connectivity, signal conditions, environmental factors, and third-party infrastructure and may vary by location and circumstances.

Copernix does not guarantee uninterrupted availability, successful signal detection, accuracy, successful location of individuals or devices, or operation in all environments, including remote, underwater, urban, or disaster conditions.

5. Safety disclaimer

You agree not to rely solely on the App for safety, survival, navigation, or emergency decisions and to maintain proper preparation, equipment, and communication methods at all times.

Copernix is not responsible for any injury, death, loss, or damage arising from reliance on the App, App failure, inaccurate results, misuse, or misunderstanding of the App.

6. Limitation of liability

To the fullest extent permitted by law, Copernix, its affiliates, partners, officers, employees, and licensors are not liable for any direct, indirect, incidental, special, consequential, punitive, or other damages arising from or related to the App, including personal injury, death, lost data, lost revenue, lost business, device malfunction, emergency response delays, or third-party charges, even if advised of the possibility of such damages.

7. User responsibilities

You agree to use the App only for lawful and ethical purposes and not for harmful, fraudulent, abusive, or non-humanitarian purposes. You are responsible for your device, battery level, connectivity, settings, and software updates and for all consequences arising from your use of the App. You are responsible for managing device settings, connectivity, and any associated data usage costs (see Section 8).

8. Data usage and charges

Use of the App may consume cellular data and may result in carrier fees, hotspot usage, overage charges, or third-party service costs.

When your device hotspot is enabled, all internet activity may use cellular data. Activities such as streaming, gaming, background applications, or other data-intensive usage can significantly increase data consumption. You are responsible for managing your device settings, including disabling hotspot or limiting background data usage when appropriate.

All such charges are solely your responsibility. Copernix is not responsible for any fees, charges, or financial impact arising from your use of the App, including but not limited to data usage, mobile carrier fees, overage charges, or third-party service costs.

9. Privacy, opt-out, and deletion

Copernix respects your privacy. You may request access to your personal data, opt out of certain data collection where applicable, or request deletion of your personal information by contacting info@copernix.ca. Requests will be handled in accordance with applicable privacy laws.

10. Intellectual property

The App, and all related software, content, technology, and materials, are owned by Copernix or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, reverse engineer, decompile, or attempt to extract source code, algorithms, or other proprietary technology from the App, except where prohibited by law.

11. Updates and changes

Copernix may update, modify, suspend, or discontinue the App or any feature, including paid features, at any time. We may also update these Terms from time to time. Updated Terms take effect when posted. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Third-party services

The App may use, rely on, or integrate with third-party services or platforms. Copernix is not responsible for the availability, performance, security, billing, or data practices of third-party services.

13. Termination

Copernix may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms, misuse the App, create risk or harm, or where Copernix otherwise deems suspension or termination appropriate.

14. Governing law

These Terms are governed by the laws of the Province of Québec and the applicable laws of Canada. Any dispute arising from these Terms or the App shall be submitted to the courts of Québec, unless applicable law requires otherwise.
